 From the Board……CCR Reminders

Periodically, the Board of Directors will send out letters to all residents of Overlook Estates to remind them of the Homeowner's Association (HOA) Rules and Regulations. These Rules and Regulations are more commonly know as Covenants, Conditions, and Restrictions (CCR's).

 

The CCR's are in place to help protect property values and to provide an attractive community in which to live through shared owner responsibilities. 

 

Following are a list of the most common CCR violations and key provisions which all residents should be sensitive to as the neighborhood expands:

  1. Fencing---A brief summary of the article governing this item is as follows: All fences must be constructed of material and in a manner approved by the Architectural Control Committee. 
    • Article IX, Section 10, as amended February 2, 2000 (Note that the original wording on page 19 has been superceded by the amendment).   
  2. Storage of  vehicles---A brief summary of the article governing this item is as follows: Boats, trailers, campers, unused/inoperable automobiles, and other machinery may be kept on lots, provided they are kept or stored within a garage or such other place so they will be completely out of view from the Common Area or any street or adjacent lot.

  3. Storage of building material---A brief summary of the article governing this item is as follows: No lot shall be used for storage of any material except that required for landscaping or construction and these materials shall not be placed or stored upon any lot until the owner is ready to commence landscaping or construction.

  4. Trash and storage of trash containers---A brief summary of the article governing this item is as follows: All rubbish, trash, garbage, or other waste shall be kept in sanitary containers and out of sight of the Common Area and any street or adjacent lot, except on days designated for pickup of such garbage by a disposal company.

  5. Keeping garage doors closed---A brief summary of the article governing this item is as follows: Garage doors shall be closed at all times, except for immediate entry or exit.

  6. Yard/landscape maintenance---A brief summary of the article governing this item is as follows: Grass, vegetation and weeds on each lot shall be cut as often as may be necessary to maintain the same in a neat and attractive condition. All damaged, diseased beyond recovery, or dead trees shall be cut and removed from any lot.

  7. Miscellaneous: Business activity restrictions (Article VIII, Section 2), Vehicle repair on lot or street restrictions (Article VIII, Section 8), On street parking restrictions (Section VIII, section 8), Sign restrictions (Section VIII, Section 10).

 

In the past, there have not been any penalties in place to help enforce the CCR’s.  The Board of Directors is currently working on guidelines that will be in place for both CCR violations and late payment of HOA dues.  As soon as these guidelines are completed we will inform the community. 

 

If any resident does not have a copy of the CCR's, including the amendment for fencing, please contact one of the HOA Board members to request a copy.
